1. Introduction & Overview

FATHOM Instruments Inc. ("FATHOM", "we", "us", or "our") is dedicated to protecting the privacy of swimmers, coaches, sports scientists, and athletic institutions who utilize Fathom OS and our deck hardware products.

This Privacy Policy explains how we collect, store, process, and protect personal information and aquatic performance telemetry when you access our marketing website, application portals, and hardware diagnostic services.

2. Information We Collect

We collect information directly from you, through your athletic institution, and automatically via Fathom deck devices:

  • Account & Institutional Info: Names, coach email addresses, school or club affiliation, roster assignments, and billing details.
  • Aquatic Telemetry Data: Split times, stroke rates, lap velocities, turn deceleration metrics, and workout timestamps captured by Fathom sensors.
  • Device & Network Data: Hardware serial numbers, battery health, Wi-Fi mesh signal strength, IP addresses, and browser user-agent tokens.

3. How We Use Your Data

We use collected information solely for valid athletic and operational purposes:

  • Delivering real-time split and stroke telemetry to coaching tablets during practice sessions.
  • Synchronizing training data across pool deck hardware nodes and cloud dashboards.
  • Diagnosing hardware reliability issues, firmware bugs, and RF interference patterns.
  • Communicating critical service updates, firmware upgrades, and security bulletins.

4. Student-Athlete & Minor Protection

Many competitive swimmers participating in programs utilizing Fathom are under the age of 18 or 13. FATHOM is committed to strict adherence to the Children's Online Privacy Protection Act (COPPA) and Family Educational Rights and Privacy Act (FERPA) standards:

  • We require institutional or parental authorization before any minor athlete profile is linked to telemetry logs.
  • We never use minor athlete telemetry or personal details for commercial behavioral advertising.
  • Athletic departments may request the complete deletion of a minor's historical telemetry records at any time.

5. Information Sharing (No Data Selling)

We do not sell athlete data. FATHOM has never sold, rented, or monetized personal information or athletic telemetry to data brokers, ad networks, or third-party marketing firms.

We share data only with trusted infrastructure subprocessors (e.g., Cloudflare Pages, Sanity CMS) necessary to deliver cloud hosting, real-time messaging, and database operations under strict data protection addenda.

6. Cloudflare Infrastructure & Security

FATHOM hosts its web and API systems on Cloudflare's global edge network. All communication between deck hardware, mobile applications, and web servers is encrypted using modern TLS 1.3 standards. Telemetry stored in databases is protected with AES-256 encryption at rest.

7. Retention & Deletion Rights

We retain telemetry data for the active duration of an athletic program’s subscription to enable longitudinal season comparisons. Upon contract conclusion, programs may request export or permanent deletion of their database records within thirty (30) days.

8. Privacy Rights (GDPR / CCPA)

Depending on your jurisdiction, you may have specific privacy rights, including:

  • Access: The right to request copies of your personal information.
  • Correction: The right to correct inaccurate athlete profile metrics.
  • Erasure: The right to request that we delete personal telemetry.
  • Portability: The right to receive telemetry files in standard machine-readable formats (e.g., CSV, JSON).

9. Cookies & Local Analytics

Our public marketing website uses minimal technical cookies necessary for session state, CDN security, and accessible user preferences (such as reduced-motion settings). We do not deploy invasive cross-site advertising trackers.

10. Updates to This Policy

We may update this Privacy Policy from time to time to reflect modifications in our hardware sensors, software features, or applicable legal requirements. The updated date will always be indicated at the top of this document.
